. we have breaking news out of alameda, that fire is still burning, it has been since 2:30 this morning and this is an apartment complex on park street. fortunately there are no reports of injuries and alex savage said everybody did make it out of that apartment complex and he will have another live update in about 15 minutes. we have developing news in the case of amanda knox.

italy's highest court has overturned her acquittal for the killing of her british roommate and that means she has been ordered to a new trial. amanda knox spend four years in prison for the crime until she was found not guilty and amanda knox said having the acquittal overturned is painful and prosecutor's theory is completely unfounded and unfair. her kidnapper is still on the loose but an 11 month old baby is safely home with her mother. that rescue came nearly five hours after the abduction prompted an amber alert. it was prompted from an suv that was stolen. her mother came out with her baby expressing joy to

firefighters are battling an early morning flame. >> reporter: yes the fire broke out in some of the apartments on the upper floors in this apartment building and you can see firefighters are trying to gain control of this fire which is a very stubborn fire and we have not seen any flames for some time. what we have seen is portions of the building actually falling down to the ground and firefighters have talked about the danger of a possible collapse here and so far we have not heard of any reports there. latter trucks have been brought in as you can see to try and get water from up above and let me show you what it looks like. this is a building at park street in alameda and it started on the upper level. it
